(valid from 01.01.2025)
General business conditions of "OH ILLUSIONS" d.o.o. valid for all leases of advertising space on the "OH ILLUSIONS" d.o.o. network. with application from 01.01.2025. year and as an attachment are an integral part of the Agreement.
In case of special requests of the Lessee - advertiser (Agency/Client), when leasing advertising space owned or leased by "OH ILLUSIONS" d.o.o. the same will be specified in the Agreement.
Article 1. General conditions
An integral part of the general conditions of sale are:
- A precise Request for Proposal
- Advertising price list "OH ILLUSIONS" d.o.o. for the year 2025
- Availability of advertising space
- Catalog of advertising areas
- Technical instructions for printing advertising material
After submitting the Request for Offer, "OH ILLUSIONS" d.o.o. is obliged to respond to the same within 3 (three) days. The list of offered advertising spaces represents the official offer in which the offer option is specified. After the expiration of the offer option, "OH ILLUSIONS" d.o.o. reserves the right to offer the advertising space to another Tenant.
The tenant cannot, without the consent of "OH ILLUSIONS" d.o.o., for the duration of the advertising campaign, leave the use of the leased areas to third parties.
Article 2. Ordering an advertising campaign
Ordering - leasing of advertising space is done exclusively in written form according to the Offer/Estimated invoice issued by "OH ILLUSIONS" d.o.o. The offer must be certified by the Tenant within the deadline specified in the offer. An integral part of the Offer/Estimate and/or Contract is the accepted/verified list of locations.
Article 3. Cancellation/postponement of the campaign reservation
In case of postponement or cancellation of ordered campaigns, the Lessee is obliged to cancel the order in writing, and the date of arrival of the written document is considered the date of postponement or cancellation of the campaign. In that case, the Lessee is obliged to pay damages in the name of compensation according to the date of the cancellation order:
If the Tenant postpones or cancels the reserved campaign in the period from 7 to 15 days before the start of the campaign, "OH ILLUSIONS" d.o.o. will invoice the amount of 100% of the net value of the reserved campaign in the name of compensation for the damage suffered.
If the Tenant postpones or cancels the reserved campaign in the period from 15 to 30 days before the start of the campaign, "OH ILLUSIONS" d.o.o. will invoice the amount of 50% of the net value of the booked campaign as compensation for the damage suffered.
Article 4. Rental price and method of payment for the advertising campaign
Price list of rental - advertising "OH ILLUSIONS" d.o.o. for the year 2025 it is expressed in EUR currency.
Rental invoices are issued on a monthly basis, on the last day of the month, for the current month.
The tenant has the right to advertise the invoice in writing within 3 (three) days from the day of receipt. After the expiration of that period, complaints against the issued invoice will not be accepted.
The deadline for payment of each advertising campaign is a maximum of thirty days (30) from the day of invoicing, unless otherwise specified in the Agreement. The exception is the special offers of the "last minute campaign". These are monthly campaigns whose planning is done 10 days before the start of the campaign and payment is made exclusively in advance, unless otherwise regulated by the Agreement. "OH ILLUSIONS" d.o.o. reserves the right to approve free campaigns for humanitarian purposes and campaigns at lower market prices for the purpose of promoting cultural goods and general public interests as well as socially responsible campaigns.
In case of delay in payment, "OH ILLUSIONS" d.o.o. reserves the right to charge the Lessee legal default interest.
"OH ILLUSIONS" d.o.o. also reserves the right not to approve advertising campaigns to the Tenant who has not settled the obligations from the previous campaign, regardless of through whom the campaign was implemented.
In case of changes in the market, caused by an increase in business costs due to an increase in taxes by state authorities, "OH ILLUSIONS" d.o.o. reserves the right to change prices and business conditions, about which the Lessee will be informed in a timely manner.
Article 5. Realization of advertising campaign
Start of online advertising campaigns "OH ILLUSIONS" d.o.o. are defined in individual Contracts with clients.
1 - APPEARANCE OF ADVERTISING MATERIAL:
The Lessee guarantees and is responsible for the quality and appearance of the submitted conceptual solution - preparations for the press.
Advertisements must be printed according to the standards of "OH ILLUSIONS" d.o.o. which are defined in the document "Technical instructions for advertising printing". The document can be viewed or obtained on request from the technical service of "OH ILLUSIONS" d.o.o. If the Lessee submits preparations for printing that do not meet the standard of advertising printing, "OH ILLUSIONS" d.o.o. has the right not to receive the preparations and the Tenant has no right to compensation. The lessee accepts full responsibility for the content of the poster and is obliged to deliver it to "OH ILLUSIONS" d.o.o. Declaration from Article 11 of the Law on Advertising in written form, no later than 15 (fifteen) days before placing the advertising material. "OH ILLUSIONS" d.o.o. has no legal liability arising solely from the content of the disputed poster.
And practical solution - advertising must not contradict the norms defined by domestic legislation, international law and public morality, and must not disparage, degrade or insult anyone's personality. In case of infringement of copyright or legal regulations, the Tenant is directly responsible to the injured third party, compensating all costs and damages resulting from it.
2 - DELIVERY OF PREPARATION FOR PRINTING:
All press preparations for the advertising campaign must be submitted to "OH ILLUSIONS" d.o.o. and no later than 15 (fifteen) days before the start of the campaign. The exception to the delivery of press preparations is "last minute" campaigns. The deadline for delivery of posters in "last minute" campaigns is 10 (ten) days before the start of the campaign. In case of delay in the delivery of press preparations, "OH ILLUSIONS" d.o.o. does not guarantee the timely placement of advertisements, nor undertakes the obligation to extend the campaign.
In the event of a delay in the delivery of press preparations, the Lessee is obliged to pay the ordered campaign in full and has no right to request an extension of the campaign. The lessee is obliged to deliver the visual appearance by e-mail or on a CD along with the preparations for the press.
Within 30 (thirty) days from the end of the campaign, the lessee is obliged to pick up advertising canvases and other advertising material used in the campaign from the "OH ILLUSIONS" d.o.o. warehouse. If the tenant does not take over the advertising materials within the given period, they will be recycled and the tenant has no right to demand any compensation.
3 - SETTING UP THE CAMPAIGN:
If the preparation for the press is delivered on time and if the weather conditions allow it, the placement of the advertising material is done within the agreed period of the advertising campaign, which is specified and specified in the Contract.
4 - CAMPAIGN PHOTO REPORT:
The photo report of the campaign is delivered to the Tenant via e-mail, no later than 5 (five) days after the end of placing the advertising material, and the delivery of the same does not condition the settlement of the Tenant's obligations towards "OH ILLUSIONS" d.o.o., because the photo documentation is proof of the realized campaign.
5 - POTENTIAL COMPLAINTS:
Complaints about the quality of posted advertising material shall be submitted by the Tenant exclusively in writing, within 5 (five) days from the completion of posting of advertising materials, with a detailed description of the complaint and evidence of omissions within the installation. After that period, complaints will not be accepted.
The lessee has the right to inform "OH ILLUSIONS" d.o.o. in writing during the campaign. about deficiencies in advertising material, which will be removed within 3 (three) working days from the date of receipt of the written report.
Article 6. Press services
PRINTING OF ADVERTISING MATERIAL - "OH ILLUSIONS" d.o.o. will perform the printing service according to the official Price List for the printing of advertising material for the year 2025, based on the ordered printing of advertising material. Printing is ordered exclusively in writing, with the exact specification for printing advertising material attached. Payment for the printing of advertising material is made on the basis of the terms defined in the Agreement.
The lessee is obliged to submit the conceptual solution/preparation for the printing of advertising material no later than 15 (fifteen) days before the start of the campaign. In the event of a delay in the delivery of the preparation for printing advertising material, "OH ILLUSIONS" d.o.o. is not responsible for the delay in the start of the advertising campaign due to untimely printing of advertising material.
The conceptual solution is delivered in TIFF or EPS format and in CMYK colors at a scale of 1:10. The resolution must be according to the supplied instructions, between 150-300 DPI (depending on the media).
Article 7. Force majeure
"OH ILLUSIONS" d.o.o. is not responsible to the Tenant if the advertising board was removed due to force majeure, which would prevent "OH ILLUSIONS" d.o.o. at the disposal of the advertising areas approved by the Tenant, or advertising materials cannot be placed at the leased locations due to bad weather.
"OH ILLUSIONS" d.o.o. will, in agreement with the Lessee, place advertising materials at replacement locations.
"OH ILLUSIONS" d.o.o. does not bear any responsibility for the damage caused to the advertising material due to force majeure, as well as for the activities of a third party, which could cause damage to the advertising material through its malicious actions, all in accordance with the Law on Obligations.
"OH ILLUSIONS" d.o.o. assumes full responsibility for damage caused by the action of advertising material (or advertising space) in relation to third parties.
Article 8. Obligation of the Agency
The Agency is obliged to inform the Client about the General Business Conditions of "OH ILLUSIONS" d.o.o. for the year 2025. By confirming the advertising campaign for the Client, by the Agency, the Agency confirms that it has familiarized the Client with all items of the General Business Conditions for 2025.
Article 9. Jurisdiction of the court
All potential disagreements of the contracting parties will first try to be resolved amicably, and for disputes that cannot be resolved amicably, the jurisdiction of the Commercial Court in Belgrade will be determined.
General terms of business "OH ILLUSIONS" d.o.o. are mandatory for all users of its services. Prime they are valid for an indefinite period of time or until they are revoked, and they come into force on the day of signing the Contract or Offer - Estimate. "OH ILLUSIONS" d.o.o. reserves the right to change the General Terms and Conditions for 2025 if the need arises. "OH ILLUSIONS" d.o.o. undertakes to promptly notify its clients of any possible changes.
